Portraits and model releases

Just a quickie. If you shoot a portrait lets say from behind so the face isn't showing and upload it then do you need a model release? Also when uploading if you don't need a model release then what do you enter where it says 'how many people are in this image' ?

If there are people or parts of people in your image, then you enter how many people are in the image.

 

If you don't have a model release, then you must license it as rights managed.

 

To answer the next question (this comes up often on the forum), no you cannot license an image here on Alamy as rights managed and then at other places as royalty free (it's in your contract with Alamy that you are not permited to do this).

I'm sure this has been asked before, so apologies in advance; what constitutes a person? A random foot, a distant unidentifiable leg, enough to maybe work out someone's identity, something different?

If a person can recognize themselves in the image, then you need a release.

 

I remember years ago another agency described a situation where a person wanted to bring suit to the agency (and photographer) because they thought it was an image of themselves on a golf course.  Once some investigating took place, the person making the claim could not prove that they were in the same country at the same time despite looking like that person from a distance.

EDIT! Just a further question! I have an image here of my twin boys when they were babies. Do they need a model release for my sons?

I'll amend them now ASAP!!

 

What about my sons?

 

EDIT: Both now amended so it reflects the amount of people in the image and no model release. I see the box that says, royalties free, rights managed etc gets greys out and defaults to rights managed when you don't have a model release. Daft question but are they still for sale and available to buy now then or by not having a model release they cannot be sold? In which case all street photography is a no go then?!

They should be available for sale soon and are fine for editorial use as long as you have indicated the number of people in the images and that you don't have model releases. Technically speaking, releases are only necessary for commercial use.

I agree, my key words are terrible! I honestly don't know what to put in them though! Is there an area on here with ideas or maybe a few examples ?

Don't think it is needed from both parents. I have a lot on here, all with only one parent signing.

It wasn't "need" if I remember correctly, just preferred under certain circumstances (the face of an advertising campaign perhaps).

Just one parent required in all my dealings with other agencies, including two rather big ones . . .

 

Have (elsewhere) commercially licensed images of my kids where I signed as both photographer AND parent, and kids' mum signed only as witness.
