John Walker
Last November one of my images was used in an article for the Telegraph and shows in my sales. It has also been used here http://www.newsbe.com/2013/11/03/pensions-crisis-only-if-youre-middle-aged/ This links back to the Telegraph article but my question is this. As my image is being used again in this link and not just a text link should I claim for the use? I have found five other similar uses of the same photo on other sites - all displaying my image with a link to the Telegraph. Cheers John
spacecadet
It's an infringement but good luck pursuing it with no contact details.
John Morrison
It happens all the time. Not saying it's right... but loads of websites just scrape content from the internet. If they're making $$$ from your image, then it should be worth going after them. If not, you're probably wasting your time...

John Walker
Thanks everyone, I think for the sake of an email it might be worth a try. I emailed another website and it looks like they're going to pay. It's only £25 but worth it for one email. Also found one that shows in my Alamy sales as a 1/8 inside page that in fact has been used for the front cover of an upmarket drinks magazine. I've let Alamy know with screenshots so fingers crossed for a result. (You may have guessed but I've just started reverse searching - very interesting) Regards John
spacecadet
£25 is letting them off pretty light.
John Walker
£25 is letting them off pretty light. Your right, just feeling the water as I've not chased up before. The image is on a website and is only about 150 pixels across. John
spacecadet
Unfortunately setting a low price limits your claim. It's usually better to send a letter requesting information on the use made, where they got the image, etc. Have a look at this for next time http://www.epuk.org/Opinion/994/stolen-photographs-what-to-do?pg=4 Infringers never get to negotiate and I'd never be asking for less than 3 figures. Even the chap who used one in a blog before I knew any better got charged £39.
John Walker
Thanks for that Mark. All part of the learning process. I seem to recall that someone put some suggested wording on the forum for making a claim against an infringer but I can't find it now. Can anyone give me a pointer please. Cryptoprocta
Find more info at: http://whois.domaintools.com/newsbe.com I don't like these low priced sales to British newspapers - always result in this kind of infringement. Not always I have the energy to pursue. I agree, particularly in the case of The Telegraph - though in my case the many offending websites almost always seem to be in the Far East. I do find it odd that Alamy accepts low-value sales but won't help following up infringements - even when they could thereby share any dues. MariaJ
These links that have been posted are very useful, thanks. i'm wondering how the laws apply to photographers outside of the UK. If I find someone stealing and using my photos from Alamy, would UK copyright laws apply because it is a UK company, or would it have to be Canadian laws, where I reside? Or something else? spacecadet
If the image appears on a monitor in Canada, it's an infringement in Canada.
