Copyright issue...

Well, I might have said that, as we  know, copyright only protects the expression of an idea, not the idea itself, and there was plenty of difference between a photograph and a railway diorama, but the model company has said outright that their model is "after a true event". So they may have put themselves in the frame. Even so I think they've only copied the idea, but they may have been unwise not to license the image. This isn't the US, of course, where litigation is a blood sport, so the outcome may be more modest. ut I would certanly be dischuffed. Sorry.

It's possible that the German right of personality law is engaged if the naked German could argue that he was so strongly identified with the photograph that anyone seeing the model would assume it was he. But he's anonymous so far, so I don't know how far that could go.
