Marketing package - non advertising

I have several times noticed sales on unreleased files coming through which are for 'Marketing package ... Use in marketing materials, ... (excludes advertising)".

 

What sort of marketing excludes advertising? Seems like a bit of linguistic nit-picking, which I'm sure could have lawyers in clover for months.

 

BTW, should I now be marking all files (and in retrospect) which might need releases as 'editorial only' (RM), or is it still 'mark unreleased and it's the responsibility of the end user' unless I want to be super safe on certain files? I must have missed any official Alamy announcement about that while I wasn't uploading.
