Closing Alamy account

I emailed a couple of questions to Alamy about what happens when we close our account, reply below. In light of this don’t forget to save details of your outstanding sales etc before the 30th June! 

 

When your contributor account has been closed you won’t have access to your dashboard – if you need to check sales or payments you can email us and we’ll check for you.

 

If you have cleared sales in your account, we will pay you those in the following payment run rather than as and when they clear.

 

Yes they will also be removed from our distributor sites.

Having left Alamy once before my advice would be as follows.

 

1. Remove all keywords and descriptions, replace with not for sale. Wait for the database refresh.

2. Delete all images, maybe leave a couple.

3. Wait for the 180 days Alamy stipulate images could still get sold.

4. Close account

Since Alamy are changing the contract and have given 45 days notice, you can inform Alamy at any time in that 45 days that you wish to close your account as you do not accept the new contract terms and they will remove all your images just before the new contract comes into force.

and since your never agreed with the new contract they should not be able to use it for any sales regardless when they happen, remembering that Alamy sales date is base on when they find out about it.

Something I have just thought of is the fact that many of us have posted our images in various threads here on the forum. Did you ask them at all about having those removed? I will do so myself once I am sure I am leaving, which is looking increasingly likely.

A thought occurred to me -- are those of us who are contemplating leaving Alamy also contemplating leaving their iPhone-based sibling "agency"?

yeah, i'm taking a breather from thinking about it for a while.  To be honest I don't feel unsafe with Alamy yet, I do think that what James wrote is true, that they don't intend to use it the way it reads AT THIS TIME.  I do think it makes us vulnerable in future, and yes my trust has been affected.

 

 

 

Canada does seem like an interesting country to explore.  I have a feeling it will be my stomping ground for a while, i think the meandering will be much lower key for a long while- thinking of heading east for a year or two when things open up. Sadly never made it to your side of Oz..... next time

I’m staying with them, for now anyway, it’s a different contract and they tell me the commission isn’t changing....

I don’t believe a single word anyone from Alamy says. If its CEO can lie about the commission change then anyone from Alamy could lie about anything. All trust is gone.

Sadly that is so true.

 

Also it doesn't actually matter what they say it means .. it's what is written in the contract that counts.

Well, things may not be quite that bad. If they say it means something, that's how they are going to play any dispute- and what they have said may become evidence anyway. Words are always subject to interpretation- IIRC we've already been shown that some of the punctuation gives rise to more than one meaning.

Also, in English law, if a contract is ambiguous it is interpreted in favour of the party that didn't draw it up- that's us.

Maybe so .. but I'd much rather it not be legally ambiguous in the first place also so far no liability insurance will cover the legal cost to find out should they change their mind .. Plus Alamy seem to be quite happy to change their mind when it suits .. such as saying they had no plan to change royalties .. Let's see if they come up with something less ambiguous.
