  1. While what you say is correct, Alamy/PA doesn't care. They know from the experience of other agencies who have trodden this well-worn path already, what will happen. 1. This thread will carry on for a couple of days. 2. Then it will run out of steam. 3. Some people will leave Alamy altogether. 4. Some people will stay, but not upload any more. 5. Some people will stay, but put restrictions on their sales. 6. 4 & 5 ^^^ are not mutully exclusive. 7. Some people will give up exclusivity and cast their images to the winds. 8. Some people will keep g
  2. This has been hinted at several times in the thread, but apolgies if I've missed it being spelled out. Alamy has set three pricing targets. It isn't even clear whether these targets are gross or net, and it's never safe to 'assume' or 'guess' when agencies go bad. But whichever, they set the prices, and apparently retain the right to give away our images. "there is not and will not be during the term of this Contract, be any limitation or restriction on Alamy’s ability to license the Content" (BAD GRAMMAR - just sayin') Thereby they are in full control of what we earn.
  3. They've got that covered: "there is not and will not be during the term of this Contract, be any limitation or restriction on Alamy’s ability to license the Content"
  4. Why did this Bonnie Tyler song come into my head? "It's a heartache Nothing but a heartache Hits you when it's too late Hits you when you're down It's a fool's game Nothing but a fool's game Standing in the cold rain Feeling like a clown"
  5. See what I wrote above. When the first person said it was possible I did it. Just proves you can't believe what Alamy tells you. Why would I try to do it when they told me I couldn't?
  6. As said above, but the distrubution page still says "You can add territories at any time, but you can only deselect territories in April." Memo to self: don't always believe what you read.
  7. Yes, I tried again when I read what Gardenbush had written. Previously, I didn't try because I'd read the note about April. See you can't always believe what you read on Alamy!
  8. That's funny, when I tried, I just got taken to that page I linked to. I'll try again, thanks. But I think with the other clauses I'm extremely concerned about, I may be out altogether.
  9. Did you get to opt out today? When I tried, I got taken to this page, which says you can't opt out until April. https://www.alamy.com/distribution-terms.aspx Correction: it says that, but you actually can. <rolls eyes>
  10. Except that we can't do it until next April: "You can add territories at any time, but you can only deselect territories in April." https://www.alamy.com/distribution-terms.aspx Sneaky timing, Alamy. Correction: seems you can opt out, although the page tells you you can't!
  11. Every agency which has done the dirty on contributors has lost a proportion of their suppliers. They presumably factor that into their accounting. Sometimes, it's about profitability rather than overall profit, for example. A concept I can't get my head round.
  12. this has been done with other agencies who did the nasty, to little, if any, effect.
  13. I'm actually even more concerned about some of the other clauses, which leave a lot of room for them to manoevre, but none for us. I've been through all this before with G.
  14. Also, people with RF-exclusive contracts elsewhere, from which they almost certainly earn more, need to be very aware of: "4.1.5. except for any rights that have previously been licensed or granted in relation to the Content, there is not and will not be during the term of this Contract, be any limitation or restriction on Alamy’s ability to license the Content;", which means they can license files we designated as RM specifically as RF, or even give them away for free for whatever purpose they choose.
  15. It's deliberatly open to interpretation: wiggle room for them. They have specifically said "any use or exploitation of the Content by Alamy, a Customer or a Distributor will not be, or be deemed to be indecent, obscene, defamatory, insulting, racist, offensive, indecent, vulgar or violate publicity rights anywhere in the world." If Alamy uses content in that way, why shouldn't they be sued? Why have they even stated that as a possibility? I'm assuming their lawyers have gone over this contract, but they can't decide what is, or is deemed to be. any of these things - laws e
  16. How is this clause even legal? "any use or exploitation of the Content by Alamy, a Customer or a Distributor will not be, or be deemed to be indecent, obscene, defamatory, insulting, racist, offensive, indecent, vulgar or violate publicity rights anywhere in the world." That's a charter for abuse.
  17. So essentially you're confirming what I suggested some months back: that Alamy really is focussing on live news, and general editorial can land where it will. Live News isn't for all of us: none of my local papers (small and hard up) pay for images (maybe they've got some paid staff, but it's not obvious if so) and nothing much happens here. But if Alamy made that clear, we could make more informed choices. Also, there have been some low figures reported from Live News sales too, i.e. within 24 hrs of submission.
  18. I looked at just one of your photos, which showed crosses at a cemetary. The caption just says "A view of Crosses above graves at a cemetery in a village" - I don't see the name of the village, or even the country in the caption or keywords. I do see the location in the location field, but that's not searchable. Also, you have Coronavirus and Covid-19 in the keywords, but also 'old cemetery', 'ancient' ruined, forgotten. Does the photo (I looked at #2FJNB00 , but see you have a series) actually show graves of people who died of Covid? If not, these keywords shouldn't be included. If
  19. 2 for $29.90 gross. Second month in a row no UKNS, which is 'curious'. Of course, the two regular sales were better for me than two UKNS would have been.
  20. I had several in a shortish period of time from some boxes of tablets. Not one since I rewrote my captions on these to start with "A stock photo of ..." (though lots of people don't know what a stock photo is.)
  21. Very low sales, but better value: 2 sales for $69.36 net, which is 12% of my 2020 total net, so 😁
